The Equal Employment Opportunity Commission (EEOC) issued a revised “Know Your Rights: Workplace Discrimination is Illegal” Poster on October 20, 2022, replacing its previous “EEO is the Law” Poster, which must be posted by all employers immediately. The Poster summarizes federal anti-discrimination laws and clarifies requirements for accommodation for a disability or religious observance or practice for a sincerely held religious belief. It also explains how employees and applicants may file complaints, providing a QR code that directs them to the EEOC’s webpage describing how to file a charge.
As with other employment law-required postings, the Poster must be posted in a conspicuous location where notices to applicants and employees are customarily posted. Additionally, employers with electronic versions of employment papers must also post the EEOC Notice electronically in the location reserved for employment notices.
The EEOC offers ready-to-print posters formatted for posting in English and Spanish, electronic posters optimized for screen readers and HTML versions in English and Spanish. Note the EEOC Poster was issued on October 19 and then revised and re-issued on October 20. Employers should be careful to avoid posting the October 19 version.
