The COVID-19 Public Health Emergency (PHE) ends on May 11, 2023. The Employee Benefits Security Administration of the Department of Labor issued a set of FAQs on March 29, 2023, to address many of these important issues.
There are a surprising number of things employers need to know about the end of the PHE.
The changes impact group health plan coverage of COVID-19 tests, vaccinations and treatment, cost-sharing and in-network rules regarding those services, extensions of timeframes for special enrollment, COBRA election and premium payments, submissions of claims and appeals to any claims denials, as well as plan enrollment periods for those employees and dependents impacted by the return of standard Medicaid and CHIP eligibility requirements.
